Sometimes parents disagree about whether to vaccinate their child.

Post-separation, parents can become entrenched in their views and disagreements can be magnified.

If parents can’t reach an agreement about whether or not to vaccinate their child, and they consider their child has individual health characteristics, then there may be no other option than to seek legal advice and possibly the assistance of the Family Court.

In past cases, the Family Court has considered expert medical evidence regarding the individual health characteristics of the child and the risks associated with vaccinations for that child. In the absence of specific health concerns, recent case authorities indicate it is likely the Family Court will order the child to be vaccinated on the basis it is in their best interest.
